Secondo la stampa specializzata (Il Sole 24 del 14 Ottobre 2019) quando la proprietà di un bene culturale viene trasferita tra soggetti privati è sempre possibile per gli enti pubblici diventarne i proprietari esercitando la “prelazione culturale”. Ma l’esercizio di questo diritto deve essere congruamente motivato, con l’indicazione della funzione pubblica che il bene acquisito dalla pubblica amministrazione è chiamato a rivestire. Lo ha precisato il Tribunale regionale di giustizia amministrativa di Bolzano con la sentenza 203 del 10 settembre scorso.
